TERMS AND CONDITIONS OF USAGE OF THE PHARMASCHOOL WEBSITES AND COURSES

YOU SHOULD READ THESE TERMS AND CONDITIONS ("T&C") CAREFULLY BEFORE USING THIS SITE. USING THE SITE INDICATES THAT YOU ACCEPT THESE TERMS REGARDLESS OF WHETHER OR NOT YOU CHOOSE TO REGISTER WITH US. IF YOU DO NOT ACCEPT THESE TERMS, DO NOT USE THE SITE.

1. INTRODUCTION
1.1You are able to access most areas of the Website without registering but certain areas of the Website are only open to you if you register or if you purchase PharmaSchool Products.
1.2 If you use any part of the Website, you shall be deemed to have accepted these T&C in full. If you do not accept them, you must leave the Website immediately.
1.3 PharmaSchool may revise these T&C at any time and will inform you by updating this posting.

2. LICENCE
2.1Unless otherwise stated, all material on the Website (including photographs and graphical images) are subject to copyright and all Intellectual Property is owned solely by PharmaSchool.

2.2 No part of the Website may be copied or stored in any other location without the Company's prior written permission. 
2.3 Any rights not expressly granted in these terms are reserved.

3. SERVICE ACCESS
3.1While we endeavor to ensure that the Website is normally available 24 hours a day, we shall not be liable if for any reason the Website is unavailable at any time or for any period. 
3.2 Access to the Website may be suspended temporarily and without notice in the case of system failure, maintenance or repair or for reasons beyond the Company's control.

4. VISITOR MATERIAL AND CONDUCT
4.1 Other than personally identifiable information, which is covered under our Website Privacy Policy, any material you transmit or post to the Website shall be considered non-confidential and non-proprietary. The Company shall have no obligations with respect to such material. The Company and its designees shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sounds, text and other things embodied therein for any and all commercial or non-commercial purposes. 
4.2 You are prohibited from posting or transmitting to or from the Website any material:
(a) that is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience; or
(b) for which you have not obtained all necessary licenses and/or approvals; or
(c) which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world; or
(d) which is technically harmful (including, without limitation, computer viruses, logic bombs, Trojan horses, worms, harmful components, corrupted data or other malicious software or harmful data).
4.3 You may not misuse the Website (including, without limitation, by hacking). 
4.4 The Company shall fully co-operate with any law enforcement authorities or court order requesting or directing the Company to disclose the identity or locate anyone posting any material in breach of clause 4.2 or clause 4.3.

5. LINKS TO AND FROM OTHER WEBSITES
5.1 Links to third party websites on the Website are provided solely for your convenience. If you use these links, you leave the Website. We have not reviewed all of these third party websites and do not control and are not responsible for these websites or their content or availability. We therefore do not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Website, you do so entirely at your own risk.
5.2 If you would like to link to the Website, you may only do so on the basis that you link to, but do not replicate, the home page of the Website, and subject to the following conditions:
(a) you do not remove, distort or otherwise alter the size or appearance of the any images or logos;
(b) you do not create a frame or any other browser or border environment around the Website;
(c) you do not in any way imply that the we are endorsing any products or services other than our own;
d) you do not misrepresent your relationship with us nor present any other false information about us;
(e) you do not otherwise use any trade marks displayed on the Website without our express written permission;
(f) you do not link from a website that is not owned by you; and
(g) your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.
5.3 The Company expressly reserves the right to revoke the right granted in clause 5.2 for breach of these terms and to take any action it deems appropriate.
5.4 You shall fully indemnify the Company for any loss or damage suffered by the Company or any of its group companies for breach of clause 5.2.

6. REGISTRATION
6.1 Where you are invited to register for any part of this Website, each registration is for a single user only. When you register you will be required to indicate your acceptance of accountability for your login as being equivalent to your personal signature. You also undertake not to share your user name and password with any other person nor to allow any other person to use your account, enter data or answer test questions under your login. Failure to comply may result in withdrawal of your access to areas of the site.
6.2 Responsibility for the security of any login details issued rests with you.

7. DISCLAIMER
7.1 While we endeavor to ensure that the information on the Website is correct, we do not warrant the accuracy and completeness of the material on the Website. We may make changes to the material on the Website, or to the products and prices described in it, at any time without notice. The material on the Website may be out of date, and we make no commitment to update such material.
7.2 The material on the Website is provided "as is", without any conditions, warranties or other terms of any kind. Accordingly, to the maximum extent permitted by law, the Website is provided on the basis that the Company excludes all representations, warranties, conditions and other terms (including, without limitation any conditions implied by law) which, but for these T&C, might have effect in relation to the Website.

8. LIABILITY
8.1 The following clauses exclude or limit our legal liability for this Website. You should read them carefully.
8.2 This site contains a large amount of complex information. We have tried to make it as clear, easy to use and as accurate as possible. However we disclaim all express or implied warranties that this site is accurate, complete, or up to date. We will have no liability to you if it is not.
8.3 The fact that information, products or services are shown on this site does not necessarily mean that:
(a)  you should rely on the information (whether provided by us or third parties);
(b)  we endorse the information, products or services provided by third parties; or
(c)  the product and services that we provide are suitable for you. It is your responsibility to check this out. Some of the services on this site may not be available or may have changed.
8.4 We, any other party (whether or not involved in creating, producing, maintaining or delivering the Website), and any of our group companies and the officers, directors, employees, shareholders or agents of any of them, exclude all liability and responsibility for any amount or kind of loss or damage that may result to you or a third party (including without limitation, any direct, indirect, punitive or consequential loss or damages, or any loss of income, profits, goodwill, data, contracts, use of money, or loss or damages arising from or connected in any way to business interruption, and whether in tort (including without limitation negligence), contract or otherwise) in connection with the Website in any way or in connection with the use, inability to use or the results of use of the Website, any websites linked to the Website or the material on such websites, including but not limited to loss or damage due to viruses that may infect your computer equipment, software, data or other property on account of your access to, use of, or browsing the Website or your downloading of any material from the Website or any websites linked to the Website. 
8.5 If your use of material on the Website results in the need for servicing, repair or correction of equipment, software or data, you assume all costs thereof. 

9. GOVERNING LAW AND JURISDICTION
These T&C shall be governed by and construed in accordance with English law. Disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the English courts.

10. PURCHASES MADE THROUGH PHARMASCHOOL.CO WEBSITE
All purchases made through the website give the purchaser the right to cancel within seven days of their purchase, or seven days of receipt of the goods. A full refund will be made providing the materials are returned unused and in original condition and no attempt has been made to complete a learning module (i.e. by taking the examination).

Privacy Policy

1. Introduction and General Terms

PharmaSchool is committed to protecting your personal information. This Privacy Policy relates to our use of any personal information you provide to us through our websites.

In order to provide you with the full range of services, we sometimes need to collect information about you. Whenever you provide such information, we are legally obliged to use your information in line with all laws concerning the protection of personal information, including the Data Protection Act 1998 (these laws are referred to collectively in this Privacy Policy as the "data protection laws").

Our websites contain hyperlinks to websites owned and operated by third parties. These third party websites have their own privacy policies, including cookies, and we urge you to review them. They will govern the use of personal information you submit or are collected by cookies whilst visiting these websites. We do not accept any responsibility or liability for the privacy practices of such third party websites and your use of such websites is at your own risk.

2. Information which may be collected

When you purchase products or services online from PharmaSchool, when you are registered for any courses and when you sign up for any free online services, such as a games account or discussion forum account we will need to ask for personal information about you. This can consist of information such as your name, e mail address, postal address, telephone or mobile number, and the company you work for.

PharmaSchool also uses cookies (see below for details).

3. How we use the information we collect

PharmaSchool will use your personal information for a number of purposes including the following:

To provide you with information you have requested (e.g. notification e-mails, password reminders or administration information such as service suspension for maintenance shut);

to contact you about a service you are using such as allocation of a resit for a failed examination

to record your scores for examinations;

To provide the Certificate Verification Code Checker service for anyone who wishes to validate your completion of a course and your examination score(s)

If we were to propose using your personal information for any other uses we would ensure that we notify you first, and to give you the opportunity to refuse.

4. Circumstances when PharmaSchool may contact you.

We may contact you:

in relation to a product or service you have purchased to make sure it works properly;

to provide you with information you have requested, such as update e-mails;

in relation to any information you have posted, for example news items or discussion forum postings;

for marketing purposes if you have specifically agreed to this

5. Sharing of Information

PharmaSchool will never share your information with anyone else except where disclosure is required or permitted by law (for example to government bodies and law enforcement agencies.

The CVC checker does allow anyone with access to your name and CVC to access information about your participation and any examination scores. This information is your responsibility and you should not share this information with anyone unless you wish them to be able to verify your certificate(s).

6. Offensive or inappropriate content on the PharmaSchool website

If you post or send offensive, inappropriate or objectionable content anywhere on or to our website, or otherwise engage in any disruptive behaviour on the website, we may use your personal information to stop such behaviour.

Where we have reasonable grounds to believe that you are or may be in breach of any applicable laws (e.g. because content you have posted may be defamatory), we may use your personal information to inform relevant third parties such as your employer or law enforcement agencies about the content and your behaviour.

7. How long PharmaSchool will keep personal information

We will hold your personal information on our systems for as long as is necessary to provide relevant services or support relevant products purchased from us. In the case that you wish to be removed from our database please e-mail us at info@pharmaschool.co.uk explaining which services you wish to remove and putting "Subscription Cancellation" as the subject line. We will delete you from the services as requested, but reserve the right to retain information if necessary in accordance with legal requirements (for example the GCP Directive 2005/28/EC).

Where you contribute to PharmaSchool websites, e.g questions in online modules, we will generally only keep your content for as long as is reasonably required for the purpose(s) for which it was submitted.

8. Finding out what personal information PharmaSchool holds about you

If you are resident in the UK under the Data Protection Act you have the right to request a copy of the personal information held about you and to have any inaccuracies corrected. (We charge £10 for information requests and will require you to prove your identity with 2 pieces of approved photographic identification.) We will use reasonable efforts to supply, correct or delete personal information about you on our files.

9. PharmaSchool Websites outside of the UK

For international users accessing the site from outside the UK, the site is administered by PharmaSchool Ltd and all personal information submitted by you to the site goes directly to PharmaSchool and will be processed in accordance with this Privacy Policy (and any local terms that apply on websites) unless terms on sites specify otherwise.

10. Changes to this Privacy Policy

This privacy policy may be updated from time to time so you may wish to check it each time you submit personal information to any PharmaSchool website. The date of the most recent revisions will appear on this page.

11. Cookies Policy -Information PharmaSchool collects from you

a. What is a cookie?

A cookie is a small amount of data, which often includes a unique identifier that is sent to your computer or mobile phone (referred to here as a "device") browser from a website's computer and is stored on your device's hard drive. Each website can send its own cookie to your browser if your browser's preferences allow it, but (to protect your privacy) your browser only permits a website to access the cookies it has already sent to you, not the cookies sent to you by other sites. Many sites do this whenever a user visits their website in order to track online traffic flows.

Cookies record information about your online preferences and allow us to tailor the websites to your interests. Users have the opportunity to set their devices to accept all cookies, to notify them when a cookie is issued, or not to receive cookies at any time. The last of these means that certain personalised services cannot then be provided to that user and accordingly you may not be able to take full advantage of all of the bbc.co.uk features. During the course of any visit to PharmaSchool Websites, the pages you see, along with a cookie, are downloaded to your device. Many websites do this, because cookies enable website publishers to do useful things like find out whether the device (and probably its user) has visited the website before. This is done on a repeat visit by checking to see, and finding, the cookie left there on the last visit.

12. Open Courses

Booking on Open Courses is made subject to full payment being received. PharmaSchool may request a Purchase Order or full payment before confirming a place on a Course. All Cancellations will incur an administration fee. Cancellations more than 28 days prior to the course will result in a total refund minus an administration fee. Cancellations between 28 and 7 days will result in a refund of 50% minus an administration fee. Cancellations less than 7 days prior to the course will result in no refund.

13. Trade Mark

PharmaSchool and the PharmaSchool Device and Logo are trademarks of PharmaSchool Limited and cannot be used without the written permission of PharmaSchool Ltd.
